TERMS OF SERVICE

These Terms of Service apply to the sleep education, consultation, coaching and related services provided by Sleep by Mon (Monica Shortt).

By booking or purchasing a service, the client agrees to these terms, subject to their rights under applicable New Zealand law.

1. Services and Professional Scope

  • Sleep by Mon provides evidence-informed, developmentally appropriate and individualised sleep education and support for infants, young children and their families.

  • Recommendations are informed by sleep biology, child development, responsive caregiving, family circumstances and the individual needs of each child.

  • Services may include assessment, consultation, written recommendations, sleep plans, practical settling guidance and follow-up support, depending on the package purchased.

  • Sleep by Mon does not provide medical diagnosis or treatment. Services are not a substitute for assessment or advice from a qualified healthcare professional.

2. Safe Sleep and Informed Choice

  • Sleep by Mon is committed to promoting recognised, evidence-based infant safe sleep recommendations, including guidance from New Zealand health authorities and relevant international professional organisations.

  • For infants, the recommended safest sleeping arrangement is on their back, in their own firm, flat, clear sleep space, close to their caregiver.

  • Sleep by Mon recognises that families have different sleeping practices, including bedsharing, room-sharing, contact sleeping and feeding to sleep. Families are encouraged to discuss their arrangements openly and without fear of judgement.

  • Where families choose to bedshare, relevant safe sleep recommendations, known risk factors and recognised risk-reduction information may be discussed and documented. Providing this information does not constitute an endorsement or guarantee of the safety of any particular sleeping arrangement.

  • Sleep by Mon assesses the suitability of individualised support according to the child's age, health, sleeping environment, family circumstances and identified safety considerations.

  • Sleep by Mon may recommend changes to a sleeping environment, modify the proposed approach, request further professional assessment, or decline or postpone services where significant safety concerns are identified or the requested support falls outside professional or insurance boundaries.

3. Client Responsibilities

  • Clients agree to provide accurate and relevant information about their child's health, development, feeding, sleeping arrangements and other circumstances that may affect sleep support.

  • Clients agree to communicate significant changes or concerns that arise during the consultation or support period.

  • Parents and caregivers remain responsible for the everyday care, supervision and safety of their children, and for decisions regarding the implementation of recommendations.

  • Sleep by Mon remains responsible for exercising reasonable care and skill in providing professional services.

4. Health and Medical Considerations

  • Clients are asked to disclose relevant medical conditions, feeding difficulties, developmental concerns and any other health-related matters that may affect their child's sleep.

  • Where appropriate, Sleep by Mon may recommend assessment or advice from a GP, Plunket nurse, paediatrician or another qualified healthcare professional before commencing or continuing support.

  • Sleep by Mon may postpone or modify services where further medical assessment is reasonably considered necessary.

5. Sleep Support and Expected Outcomes

  • Sleep is influenced by biological, developmental, environmental and individual factors. Responses to changes in sleep routines or settling practices will vary.

  • Some children may express frustration or distress when familiar routines change. Sleep by Mon aims to provide responsive, age-appropriate strategies that consider each child's emotional and physical needs.

  • Recommendations are developed collaboratively and may be adjusted in response to the child's needs, family circumstances and progress.

  • Although Sleep by Mon aims to provide practical and effective support, specific outcomes, improvements or timeframes cannot be guaranteed.

6. Payment

  • Full payment for sleep consultation packages, add-ons and additional follow-up support is required before services commence, unless otherwise agreed in writing.

  • The consultation process will begin once payment has been received and any required intake information has been completed.

  • Any additional fees, including international payment processing charges where applicable, will be disclosed before payment is confirmed.

7. Travel and Home Consultations

  • Travel within the Tauranga city area is included in the applicable home consultation package price.

  • For consultations outside the Tauranga city area, additional travel charges apply at $0.95 per kilometre plus $15 per 15 minutes of travel time.

  • Any applicable travel charges will be communicated and agreed upon before the consultation is confirmed.

  • Additional consultation time beyond the duration included in the purchased package is charged at $59 per hour, with the client's agreement.

8. Cancellations and Refunds

  • Clients wishing to cancel or reschedule a consultation are asked to provide as much notice as reasonably possible.

  • Where a service is cancelled before work has commenced, any refund will be determined according to the services purchased, costs reasonably incurred and applicable consumer rights.

  • Where assessment, consultation, preparation of a sleep plan or other services have already been provided, Sleep by Mon may retain payment reasonably attributable to those completed services, subject to applicable law.

  • Once a personalised sleep plan has been delivered, a change of mind does not automatically entitle the client to a refund.

  • Nothing in this section limits any rights or remedies available under the Consumer Guarantees Act 1993 or other applicable New Zealand legislation.

9. Follow-Up Support

  • Follow-up support is provided according to the inclusions and duration of the package purchased.

  • Depending on the package, communication may take place through a shared sleep log, email, text, Facebook/Instagram Messenger or an agreed phone consultation.

  • Where included, clients may request a phone consultation of up to 30 minutes at a mutually convenient time.

  • Standard follow-up support must be completed within one month of the initial consultation, unless otherwise agreed in writing.

  • Additional follow-up support purchased separately must be used within two months of the original package purchase, unless otherwise specified.

  • Clients are encouraged to communicate openly throughout the support period so that recommendations can be reviewed and adjusted where appropriate.

10. Confidentiality and Privacy

  • Sleep by Mon respects the privacy of families and treats personal information shared during consultations as confidential, subject to applicable legal and professional obligations.

  • Personal information will be collected, stored, used and disclosed in accordance with the Sleep by Mon Privacy Policy and applicable New Zealand privacy law.

11. Intellectual Property

  • Personalised sleep plans, guides, written recommendations and educational resources supplied by Sleep by Mon are intended for the purchasing client's personal and family use.

  • These materials may be shared with caregivers or healthcare professionals directly involved in the child's care.

  • They must not be reproduced, distributed publicly, sold or used commercially without prior written permission.

12. Professional Responsibility and Consumer Rights

  • Sleep by Mon will exercise reasonable care and skill in providing services, using information available at the time of consultation.

  • Clients acknowledge that recommendations depend on the accuracy and completeness of information provided and that outcomes may be influenced by circumstances outside Sleep by Mon's control.

  • Nothing in these Terms of Service excludes, restricts or modifies rights, guarantees or remedies that cannot lawfully be excluded under New Zealand law.

13. Changes to Terms

  • Sleep by Mon may update these Terms of Service from time to time.

  • Updated terms will be published on the website. The terms applicable to a booking will ordinarily be those provided or made available when the booking was accepted, unless changes are subsequently agreed or required by law.
